These Terms of Service comply with French law, the General Data Protection Regulation (GDPR), EU Data Act, and the French SREN Law (Loi Visant à Sécuriser et à Réguler l'Espace Numérique).
1. Acceptance of Terms
By accessing or using Profilo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Profilo ("Company," "we," "us," or "our"), a company based in France.
By using our Service, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.
2. Service Description
Profilo is a Software-as-a-Service (SaaS) platform that provides AI-powered job application assistance, including but not limited to:
- AI-powered resume and cover letter generation
- Job compatibility analysis and matching
- Professional profile optimization
- Application tracking and management
- Chrome extension for LinkedIn integration
Our Service utilizes artificial intelligence technologies that may require significant computational resources. While our AI services can be computationally demanding, we have optimized our application to provide fast and efficient service delivery.
3. Credits System and Payment Terms
3.1 Credits-Based Service Model
Our Service operates on a credits-based system where Users purchase credits to access various features and services. Credits are the exclusive currency for using our SaaS platform and its AI-powered functionalities.
3.2 Credit Purchase and Usage
- Credits must be purchased through our web application before using the Service
- Different features consume different amounts of credits based on computational complexity
- Credits are consumed immediately upon successful completion of a service request
- Users can monitor their credit balance through their account dashboard
3.3 Non-Refundable and Non-Transferable Policy
Important: Once purchased, credits are:
- Non-refundable: Credits cannot be refunded under any circumstances
- Non-transferable: Credits cannot be transferred between accounts
- Non-exchangeable: Credits cannot be exchanged for cash or other value
3.4 Credit Disputes and Support
Any issues, disputes, or questions related to credits must be resolved exclusively through our web application support system. We do not provide credit-related support through external channels.
3.5 Account Deletion and Credits
When a User permanently deletes their account, all unused credits associated with that account are automatically forfeited and cannot be recovered. Users acknowledge that account deletion results in the immediate and irrevocable loss of all remaining credits.
4. User Accounts and Registration
To use our Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breaches
- Providing accurate and up-to-date information
5. Artificial Intelligence and Service Performance
5.1 AI-Powered Services
Our Service utilizes advanced artificial intelligence and machine learning technologies to provide personalized job application assistance. While these AI services can be computationally demanding and resource-intensive, we have optimized our platform to deliver fast and efficient results.
5.2 Service Performance
We strive to maintain high performance standards and fast response times. However, AI processing times may vary based on:
- Complexity of the requested analysis or generation
- Current system load and demand
- Size and complexity of input data
5.3 AI Limitations
Users acknowledge that AI-generated content is based on algorithms and machine learning models that may not always produce perfect results. While we strive for accuracy, Users should review and verify all AI-generated content before use.
6. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal, harmful, or fraudulent purposes
- Attempt to reverse engineer, decompile, or extract our AI algorithms
- Share, sell, or redistribute credits or account access
- Upload false, misleading, or copyrighted content
- Interfere with or disrupt the Service or its servers
- Create multiple accounts to circumvent credit limitations
- Use automated tools to access the Service without permission
7. Intellectual Property Rights
7.1 Company Intellectual Property
The Service, including all software, algorithms, AI models, designs, text, graphics, and other content, is owned by Profilo and protected by intellectual property laws.
7.2 User-Generated Content
You retain ownership of the content you upload to the Service. By using our Service, you grant us a limited license to process your content for the purpose of providing our AI services.
7.3 AI-Generated Content
Content generated by our AI services (resumes, cover letters, analyses) is provided to you for your use. However, you are responsible for ensuring the accuracy and appropriateness of all generated content before use.
8. Data Protection and Privacy
Our collection, use, and protection of your personal data is governed by our Privacy Policy, which complies with GDPR, French data protection laws, and the EU Data Act. By using our Service, you acknowledge that you have read and understood our Privacy Policy.
9. Service Availability and Modifications
9.1 Service Availability
We strive to provide continuous service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
9.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes when possible.
10. Termination
10.1 Termination by User
You may terminate your account at any time through your account settings. Upon termination, all unused credits will be forfeited and cannot be recovered.
10.2 Termination by Company
We may terminate or suspend your account immediately if you violate these Terms or engage in prohibited activities. In case of termination for cause, no refund of credits will be provided.
11. Limitation of Liability
To the maximum extent permitted by French law, Profilo shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Damages resulting from AI-generated content accuracy
- Service interruptions or technical failures
Our total liability to you for all claims shall not exceed the amount you paid for credits in the 12 months preceding the claim.
12. EU Data Act Compliance
In compliance with the EU Data Act (effective September 2025), we provide:
- Data portability tools for easy migration to other services
- Transparent pricing for data export and account termination
- No excessive contractual barriers to switching providers
- Reasonable assistance for data migration upon request
13. Governing Law and Jurisdiction
These Terms are governed by French law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the French courts. Users located outside France agree to submit to the jurisdiction of French courts for any legal proceedings.
In the event of a dispute, we encourage Users to first contact us through our support system to attempt an amicable resolution.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
15. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify Users of material changes by:
- Posting updated Terms on our website with a new effective date
- Sending email notifications to registered Users
- Displaying prominent notices within the application
Continued use of the Service after changes constitute acceptance of the updated Terms.

All questions, disputes, claims, or requests related to these Terms of Service must be submitted through our web application support system.
Important: Terms of Service support is exclusively available to registered users through the Profilo web application. You must log in to your account to access support forms and submit any legal or service-related inquiries.
16.1 Support Access Requirements
- Account Required: You must have a registered Profilo account
- Web Application Only: Support forms are available only within the app
- Authenticated Access: All support requests require user authentication
- No External Support: We do not provide Terms of Service support through external channels
16.2 Types of Support Available Through the App
- Credits and Billing: Issues related to credits, purchases, and account billing
- Legal Inquiries: Questions about these Terms of Service
- Account Termination: Requests for account closure and data deletion
- Service Disputes: Complaints or disputes regarding service performance
- Compliance Issues: Reports of Terms of Service violations
16.3 Response Times
We will respond to all Terms of Service inquiries submitted through our web application within 30 business days. Urgent legal matters will be prioritized and handled as quickly as possible.
